What Worker's Compensation Benefits are Available?

  • Medical benefits: Worker's compensation covers all medical expenses related to your work injuries, including doctor visits, necessary surgery, prescription medication, rehabilitative therapy, and other medical care.
  • Lost wages: If you will be temporarily incapable of working due to your injuries, you may be entitled to a percentage of your wages in weekly income benefits for up to 156 weeks.
  • Disability benefits: If your injuries are so severe that they are classified as either permanent total disability (such as a brain or spinal cord injury) or permanent partial disability (such as the loss of a hand or arm), you may be entitled to additional payments. Disability benefits are calculated using a percentage of your wages (over the course of your remaining working career) and the percentage of your body that is disabled. Typically, total disability benefits are given according to a lump-sum settlement agreement. Additional payment may also be awarded for permanent scarring and disfigurement.
  • Death benefits: A surviving spouse and children of a worker who died in a work-related accident are entitled to compensation for funeral expenses and a percentage of their family member's wages up to a certain limit.

Additional Compensation May Be Available

Although your employer cannot be sued, you may have a third party negligence claim against someone else for your work-related injuries. $32,500 SETTLEMENT OBTAINED IN A SEAMAN’S WAGE CLAIM
Vessel owner failed to make a written fishing agreement with the plaintiff seamen prior to leaving port as the law requires. Without a written agreement, under the current law, the seamen were entitled to the highest rate of pay at the port.
