Boston Cruise Ships Attorney

New England Cruise Ship and Boat Passenger Injury Trial Lawyers

Have you suffered an injury while riding on a harbor cruise, whale watching vessel or ferry boat? You may be entitled to seek compensation for medical expenses and lost earnings, as well as additional money for punitive damages, in the event of gross negligence on the part of the vessel owner and operator.

Don't Count on the Insurance Company

The insurance adjustor for the ship or vessel owner will try to tell you that you don't have a claim. No doubt they may even point to the waiver of indemnity you signed before you stepped on board. The truth is, indemnity waivers don't release the boat owner or operator from negligence. You are still entitled to damages if you can show that negligence or malfeasance contributed to the accident.

If you have been injured while riding on a commercial sight-seeing cruise, fishing charter or other boat or vessel used to transport passengers for a fee, talk to an experienced admiralty and maritime law trial attorney at THE KAPLAN/BOND GROUP, in Boston or New Bedford, Massachusetts. We have more than 100 combined years of experience in all areas of litigation relating to boat and ship passenger injuries.

U.S. Supreme Court Victory

Our attorneys have extensive experience in all areas of maritime law injury claims. Our reputation for excellence serves our clients well in courts at every level. Most recently, our representation of an injured seaman led to another major victory in the United States Supreme Court: Stewart v. Dutra Const. Co., 543 U.S. 481 (2005), which served to expand the rights of injured seamen nationwide.

Why does our experience in maritime and admiralty law make a difference? Lawyers who do not focus on maritime law are often unfamiliar with deadlines and filing requirements that are different than common personal injury litigation cases. We know the legal nuances and different requirements for filing deadlines and discovery of evidence.

Contact us to discuss your cruise ship or boat passenger injury claim. Our trial experience is the difference you need.

$32,500 SETTLEMENT OBTAINED IN A SEAMAN’S WAGE CLAIM
Vessel owner failed to make a written fishing agreement with the plaintiff seamen prior to leaving port as the law requires. Without a written agreement, under the current law, the seamen were entitled to the highest rate of pay at the port. Because the seamen deckhands were paid less than the full share received by other deckhands on the vessel, The Kaplan/Bond Group was able to obtain $32,500.

Stewart v. Dutra Landmark Case Our most recent landmark victory was achieved before the United States Supreme Court in the case of Stewart v. Dutra Const. Co. The ruling we achieved changed the law and expanded the rights of injured seamen nationwide.

Convincing Hi-Tech Presentations
We’re not merely on the cutting edge of multimedia trial advocacy – we forge it. Our multimedia approach to trial advocacy goes far beyond a picture being worth a thousand words. Our presentation techniques incorporate the use of 3D animation, “60-minute” style witness interviews, and meticulous legal writing to hit hard and severely diminish the insurance companies’ ability to defend against the truth. We have been complimented by judges, adversaries, and even the insurance adjusters that run the defense leading to favorable results and courtroom victories.
